Introduction to Airway Bill【悟空海运】
Airway bill,similar to the International Railway Bill, is quite different from ocean Bill of Lading. It is an important transport document issued by the carrier or its agent's as a contract of transportation ,binding upon both parties. Airway Bill is not negotiable, thus holding the Airway Bill cannot claim the ownership of goods.
(I )The Airway Bill is the contract of transportation between the shipper and carrier. Airway Bill not only proves the existence of the air transport contract, and the Airway Bill itself is the evidence of the binding contract of transportation between the shipper and the carrier, which comes to effect after the two sides signed the Airway Bill and expires when the goods have been delivered to the consignee thereon after arrival.
(2) The Airway Bill is a receipt certifying that the goods have received. The Airway Bil] is also a goods' receipt, which is to be issued after the shipper delivers the goods and the carrier or its agent issues one bill to the shipper to prove its receiving such goods. Unless otherwise provided, the bill is the proof that the carrier receives the goods in good order and condition.
(3 )The Airway Bill is a bill of the air freight for the carrier to check. The Airway Bill indicates
accordingly the expenses bom by the consignee and the charges paid to the carriers and the agent, and list the charge's classification and amount in details, thus the Airway Bill can be used as the freight bill and invoice. The carrier often regard the bill (the one page for the carrier) as a proof of an account.
(4) The Airway Bill is one of documents for customs' requirement. During export procedures, Airway Bill is one of documents for customs declaration. And during import clearance, Airway Bill is usually the basic document required by the customs.
(5) The Airway Bill can be as an insurance certificate. Airway Bill can be adopted by the carrier to undertake the insurance or to act as an insurance agent to undertake the insurance.
(6) The Airway Bill is a gist of the carrier's internal business. Airway Bill, carried along with the goods' conveyance, indicates items related to the consigning, transshipping and taking the delivery of the goods, which provide the carrier how to arrange the carriage of the goods accordingly.
Original Airway Bill is a triplicate unite, with the clause printed on the back for each. The first unite is for the shipper as the gist of cargo receipt certifying that the carrier or its agent have received goods ； the second is to be retained by the carrier as the proof of charging； and the last unite bound a- long with goods is the basis to check goods when delivered to consignee after the arrival at the destination.
